Lawmaking in the System of Legal Categories

Аннотация / Annotation:
This article explores the contradictions in the relationship between the concepts of lawmaking, law formation, and legal regulation. Existing concepts are either linear or excessively fragmented through the use of intermediary terms. This results in a variety of «narrow» and «broad» approaches that blur the semantic boundaries of lawmaking. An attempt is made to establish a dialectical relationship between these concepts and present an adequate approach to their delineation.

Theoretical and legal foundations of the morality of the state: setting a scientific problem

The article is devoted to the formulation of the scientific problem of the need to research and explain the concept, nature, ontology and meaning of the morality of the state. The author’s interpretation of the general concept of «morality» is described. The concept of describing and explaining the complex ontology of the relationship and interaction of the system of law and morality (as a regulatory system) at six ontological levels is also outlined.

As a result of the analysis, the definition of the term «upbringing» in a general (broad) sense has been formulated and amendments to laws have been proposed that allow individual officials to be dismissed from work for non-fulfillment or improper fulfillment by these persons, as parents, of their duties to raise children.

It examines the main types of cybercrimes, their quantitative and qualitative indicators, as well as countermeasures. The study uses open data from the Ministry of Internal Affairs (MVD), the Federal Security Service (FSB), and expert reports for 2024–2025. Special attention is paid to the role of artificial intelligence, social engineering, and international cooperation in the fight against digital crime.

Self-Defense in Civil Law: A Non-Jurisdictional Form of Protection?

The article critically re-examines the qualification of self-defense as a non-jurisdictional form of protection. The choice of method of protection is determined by the object of protection – a right or a legally protected interest. It is shown that self-defense does not possess the characteristics of stages and formalization, which excludes the specific attribute of such a generic category as a form of protection. The conclusion is drawn that it is impossible to protect a right through self-defense. The need for conceptual development of the category of “civil law possibility” is emphasized.
