The problem of methodological pluralism of research in the category of civil liability

The article is devoted to the methodological problems of such a legal category as civil liability by analyzing the category of legal liability. The reason for the methodological pluralism of research in this category is the absence of its legislative consolidation, which entails the development of multipolar research approaches. It is advisable to overcome this problem through the prism of the concept of social practices and a comprehensive analysis of related phenomena.

Using formal logic methods in the classification of crimes

The article shows that the qualification of crimes is based on a logical process. The difficulties that arise due to the competition of the General and special rules, as well as the competition of the whole and part, are considered. From a logical point of view, these phenomena are based on the relation of genus and species, as well as the relation of the whole and parts. Recommendations are given on how to distinguish these phenomena from each other, which will help to minimize errors in the qualification process.

The author comes to the conclusion that the legal consciousness of Russian society is split in dividing the positions of groups that perceive digitalization as an extension of the rights of citizens, and groups that see them as a manifestation of legal discrimination. Recommendations are put forward for the emphasized legal protection of citizens, whose interests may be violated as a result of an objective transition to new technological structures.
