This article examines the experience of Russia and other CIS countries regarding the specifics of realizing the right to higher education for foreign citizens. Particular attention is given to the experiences of Russia, Belarus, Kazakhstan, Uzbekistan, and Kyrgyzstan. The authors highlight certain positive practices of these CIS countries that could be adopted for implementation in Russia.

The authors draw attention to the peculiarities of legal decision-making by different subjects of law in conditions atypical (non-standard) situations for them. In difficult circumstances, the choice made may have a negative impact on the preservation and protection of human rights and freedoms. Three options were analyzed: introduction of a special legal regime in the region; crisis socio-economic situation; recognition of the previously adopted legal act as non-legal.

A comparative legal analysis of preventive measures in economic criminal cases in the Russian Federation and the Republic of Tajikistan has been conducted. Their legal nature, correlation with punishment, and impact on rights have been examined. The following problems have been identified: formalistic application of arrest prohibitions, terminological ambiguity, and insufficient reasoning of decisions. Trends in the application of measures and the effectiveness of alternatives have been analyzed. Recommendations have been proposed for standardizing terminology and strengthening oversight over the enforcement of restrictions.
