Norms, regulating an order and terms limiting a person suspected in moving of concluding a pre-trial partnership agreement, are considered in the article. As a result of analysis of these norms written in the Article 40.1 of the Criminal and Procedue Code of the Russian Federation it is concluded that a motion of a pre-trial partnership agreement can be made by a suspected person not on a full stage of a preliminary invesigation, but only before a moment of a noticing of closing of an investigative process.
