The digital transformation of higher education actualizes the problem of distinguishing between the lawful training of programmers and criminally punishable acts. The integration of generative neural networks into the educational process blurs the boundaries of the actus reus of the crime provided for in Article 273 of the Criminal Code of the Russian Federation. Particular theoretical and practical significance is attached to the doctrinal determination of the moment of completion of malware creation when using artificial intelligence, as well as establishing the elements of the mens rea in the absence of criminal intent on the part of the student.

Proposals have been formulated to clarify Articles 1334 and 1335.1 of the Civil Code of the Russian Federation in relation to the automated analysis of data and model training.
